Oral Argument Presented to Maine Law Court

On May 9, 2012, Gerald Petruccelli presented oral argument to the Maine Law Court in Thomas Barr, Jr. et al. v. Richard Dyke et al., a case in which the Law Court is being asked to decide whether a suit brought by former Bushmaster, Inc. shareholders is precluded by a stock purchase agreement entered into as part of a settlement of an earlier lawsuit. Mr. Petruccelli and James Haddow represent Mr. Dyke and other former officers and directors of Bushmaster, Inc. in the litigation commenced by two former shareholders, Thomas Barr, Jr., and Claude Warren. Mr. Barr and Mr. Warren appeal from the judgment entered in the Business and Consumer Docket granting summary judgment against them on their complaint, which sought rescission of the stock purchase agreement and also alleged breach of fiduciary duties, fraud, unjust enrichment, and infliction of emotional distress by the former officers and directors of Bushmaster.
